Plagiarism

It had recently come to my attention that the Sapphire Reiki website is using my What is Reiki? article on the front page of their website.

While I'm quite proud of this article, I really do hate my work being stolen without credit. Or asking.

The website gave no email contact whatsoever that I could find, but I called the number of the practitioner and asked him to either link back to my site and properly credit me or to remove my article.

I don't know how long they've had it up, passing it as their content, but that really irks me. I've done a lot of work trying to educate people about Reiki and have been working on getting my own school off the ground. Also, as a writer, I expect to be paid for my work.

I give him a couple of days, then I contact my lawyer. Seem fair?

Edited because I'm not giving him a week.

Thanks. I hope the guy is cool about it. I might have been if he'd bother to ask first. I wonder how long it's been like that, and I didn't even know.

UGH, I hate that... but believe me this is a lot more common than we think. One thing I'd suggestion, maybe write a blurb in your web site that all information is not to be taken without the sole permission of the author?

I can't believe how many people will take things like that and not even bother to credit. If you like it enough to use it, let the author know. Once anything is written, it's automatically copyrighted by the author. People learn about plagiarism in grade school. It's really common knowledge and decency. I've seen people write out copyrights on their work before, and honestly, I've always found it off-putting. I don't want to do that. I expect people to credit and link if they like what I've written. If they haven't and I find out, I'll ask them to do so.

That's quite worrisome, especially since you make it clear that some parts are your own opinion. You think he'd at least personalise it with his own thoughts.

Not someone I'd ever want reiki from. I'd have given him 48 hours myself.

Yeah, I might not wait a week. That was part of what really peeved me, is I talk about it from a very personal spiritual perspective. Even about 'kissing boo boos' in reference to my children. They obviously put enough effort into formatting it the exact same way. But not linking me? No.

Wow, that's really really wrong. And to think that someone be it you or someone else wouldn't notice? I wonder how much other content they're putting up without crediting. I think you're absolutely doing the right thing. I'd be pretty hurt and angry, too.

Mostly because it was so personal.

I just happened to find out about it because someone posted Copyscape to twitter. My LJ turned up no matches, but I searched that page because I thought it was one of my best articles. I imagine you have to do individual entries past the public first page. It makes me wonder what else has been snagged that I just don't know about.

That's so sweet of you. Thank you! I think I'm going to contact the GoDaddy abuse team, seeing as how he's so darn blatant about not caring. I may do it tomorrow, if I can get my head in the right space.

Don't waste $ on a lawyer right away.
Also don't dick around with e-mails saying "take it down."
He's in violation of the Digital Millennium Copyright Act.
Google "DMCA notice" and you'll find several examples of a properly written DMCA form.
Fill one out & send it to him in the body of an e-mail, there's specific language that needs to be used.
If he doesn't take it down AFTER the notice THEN you get a lawyer, as he's looking at fines of $10,000 a day after notice is properly given.
A simple e-mail or call saying "take it down" doesn't count (legally) as "proper notice."

my friend tmepol saw one of his photos on a tshirt site and got like a thousand bucks out of the guy. do you need to copyright it first? that's what he did before he even contacted them.

I did call him that night, and he's come by here and apologized. He says he's taking it down.

Technically you don't need to shell out money to copyright something, because you already own the copyright the moment you create it. It's just easier to prove if you've previously published it (online or elsewhere).
